These terms are an agreement between you and Xiaodong Li, the individual developer of Lingoreel (小听) (“we”, “us”). They cover the Lingoreel app for iPhone, Apple Watch, CarPlay and Apple TV, the services behind it and the website lingoreel.com (together, “Lingoreel”). By using Lingoreel you agree to these terms and to our Privacy Policy.
Who can use Lingoreel
You must be at least 13 years old, or older if your country requires a higher age to consent to online services on your own (for example, 16 in some countries of the European Economic Area). If you are under the age of majority where you live, you need permission from a parent or guardian, who agrees to these terms for you.
Your account
- Give accurate information when you sign up and keep it up to date.
- Keep your password safe. You're responsible for what happens under your account.
- If you think someone else is using your account, tell us right away at support@lingoreel.com.
Using Lingoreel without an account
You can use Lingoreel as a podcast player without an account. In that case your library and progress are stored only on your device, and we can't restore them if you delete the app or lose the device. Some features (such as asking questions, requesting new subtitles, the wordbook, reviews, the daily plan, importing shows, Pro and subtitle credits) need an account.
Lingoreel Pro subscriptions
- Lingoreel Pro is offered as a monthly or yearly auto-renewing subscription, purchased through Apple's App Store. Prices are shown in the App Store before you buy.
- Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period, and your Apple Account is charged for the renewal within the 24 hours before the period ends.
- You can manage or cancel the subscription in your Apple Account settings (on iPhone: Settings › Apple Account › Subscriptions). Cancelling stops the next renewal; Pro stays active until the end of the period you already paid for.
- Billing, payment and refunds are handled by Apple under Apple's terms. We can't issue refunds ourselves; you can request one from Apple at reportaproblem.apple.com.
- Deleting the app or your Lingoreel account does not cancel your subscription.
- We may change the features and allowances included in Free or Pro. If a change materially reduces what you've paid for, we'll tell you in the app in advance where reasonably possible.
Subtitle requests and credits
Subtitles that already exist are free for everyone. Having new subtitles made for an episode uses a request from your monthly allowance or, beyond it, subtitle credits. On the free plan you can also use a credit to have them made first. The app shows what a request uses before you confirm it.
- Each account gets a monthly allowance of new subtitle requests that depends on its plan. The allowance resets at the start of each calendar month, and unused requests don't carry over.
- Subtitle credits are consumable in-app purchases made through Apple's App Store. Prices are shown in the App Store before you buy, and payment is charged to your Apple Account when you confirm the purchase.
- Credits are added to the Lingoreel account you're signed in to. They don't expire, have no cash value, can't be transferred to another account or exchanged for money, and are lost when you delete your account.
- If subtitles can't be made for a request, the credits or monthly request it used are returned to your account. Asking for subtitles that someone else has already requested uses nothing.
- Billing, payment and refunds are handled by Apple under Apple's terms. We can't issue refunds ourselves; you can request one from Apple at reportaproblem.apple.com. If Apple refunds a purchase, its credits are taken back from your balance, even if you've already used them.
Podcast content
Podcasts, including their audio, titles, descriptions and artwork, belong to their publishers. Lingoreel finds and plays them from their public RSS feeds: the audio and artwork are streamed or downloaded directly from the publishers' own servers, and we don't host copies of the audio. Episodes you download for offline listening stay on your device. A show's page in the app always shows its name, artwork and author, and its episodes play from the original feed.
When a signed-in user asks for it, our servers transcribe an episode with speech recognition and translate it with an AI model, so the app can show sentence-by-sentence subtitles. Transcripts and translations are shown only to users inside the app. We don't publish them on the web or sell them, and they aren't available outside the app.
We aren't affiliated with the publishers or with the podcast apps whose share links you can import, and listing a show doesn't mean they endorse Lingoreel or that we endorse the show.
Content owners
If you own or publish a podcast, you can ask us to remove it from Lingoreel. Email support@lingoreel.com with the show's name or a link to it and proof that you own it, for example by writing from the owner email address listed in the show's feed or by including confirmation from your hosting platform. Once we've verified the request, we remove the show from the catalog and search, delete all transcripts and translations of its episodes and block it from being added again, usually within one business day.
You can contact us the same way with questions or to ask us to change how your show is attributed. A summary is on our support page under For podcasters.
Transcripts, translations and AI answers
- Transcripts, translations, explanations and answers are generated automatically with speech recognition and AI models. They may contain mistakes, so don't rely on them where accuracy really matters (for example medical, legal or financial matters).
- They are provided inside the app for your personal, non-commercial language learning and listening only, and you may not redistribute them (see Acceptable use).
- Questions you ask and words you save remain yours. You allow us to store and process them to provide Lingoreel to you, as described in our Privacy Policy.
Acceptable use
When using Lingoreel, you agree not to:
- scrape, crawl or bulk-download the catalog, transcripts, translations or our servers' data, or access our services other than through the app and website;
- copy, modify, reverse engineer, decompile or disassemble the app, or get around its limits or security, except where the law expressly allows it;
- abuse the AI features: send automated or excessive requests, use them for purposes unrelated to listening and learning, try to extract their instructions, or try to make them produce illegal or harmful content;
- publish, sell or otherwise redistribute transcripts, translations or answers;
- interfere with Lingoreel, other users or the networks it runs on, or use it in a way that breaks the law or someone else's rights.
Our app and your license
Lingoreel's software, design, text and brand belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, as permitted by these terms and the App Store's Usage Rules. If you send us feedback or ideas, we may use them without any obligation to you.
Suspension and termination
- You can stop using Lingoreel at any time and delete your account in the app (Me › Privacy & data › Delete account). Deletion is permanent and removes your learning records and any unused subtitle credits. It doesn't cancel an Apple subscription.
- We may suspend or close an account that breaks these terms or abuses the service, including abuse of the AI features. Where reasonable, we'll tell you why and give you a chance to respond.
- If we ever decide to shut Lingoreel down, we'll give reasonable advance notice in the app where possible.
Disclaimers
To the extent permitted by law, Lingoreel is provided “as is” and “as available”. We don't promise that it will always be available, uninterrupted or error-free, that every podcast or episode will be available or have a transcript, or that you'll reach any particular level in a language.
Limitation of liability
To the extent permitted by law, we aren't liable for indirect, incidental, special or consequential damages, or for lost profits, data or goodwill, arising from your use of Lingoreel. Our total liability for any claim relating to Lingoreel is limited to the amount you paid for Pro and subtitle credits in the 12 months before the claim arose.
Nothing in these terms limits liability for our intentional misconduct or gross negligence, or any liability that can't be limited under applicable law, including Japan's Consumer Contract Act.
Apple App Store terms
If you downloaded Lingoreel from Apple's App Store, Apple's Licensed Application End User License Agreement also applies. In addition:
- These terms are between you and us only, not with Apple. We, not Apple, are solely responsible for Lingoreel and its content.
- Apple has no obligation to provide any maintenance or support services for Lingoreel.
- If Lingoreel fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Lingoreel.
- Apple is not responsible for addressing any claims by you or any third party relating to Lingoreel or your possession or use of it, including product liability claims, claims that it fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that Lingoreel or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a US government embargo or designated by the US government as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties.
- You must comply with applicable third-party terms when using Lingoreel, such as your mobile data plan.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
- Questions, complaints or claims about Lingoreel should be sent to us at support@lingoreel.com.
Governing law and courts
These terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance for any dispute arising from or relating to these terms or Lingoreel.
If you are a consumer, nothing in these terms takes away the protection of mandatory laws of the country where you live.
Changes to these terms
We may update these terms from time to time. We'll post the new version here with a new effective date, and announce material changes in the app before they take effect where reasonably possible. If you keep using Lingoreel after the changes take effect, you accept the updated terms.
General
If any part of these terms is found unenforceable, the rest stays in effect. If we don't enforce a right right away, we haven't given it up. These terms, together with our Privacy Policy and, for App Store downloads, Apple's Licensed Application End User License Agreement, are the whole agreement between you and us about Lingoreel.
